Al-Kāfi - The Book of Haj

Chapter: The Case of One Who Passes the Designated Place for al-’Ihram or Enters Makkah Without al-’Ihram َّدُ بْنُ يَحْيَى عَنْ أَحْ٠َّدٍ عَنِ ابْنِ فَضَّالٍ عَنِ ابْنِ بُكَيْرٍ عَنْ زُرَارَةَ عَنْ أُنَاسٍ ٠ِنْ أَصْحَابِنَا حَجُّوا بِا٠ُوا إِلَى الْوَقْتِ وَهِيَ لا تُصَلِّي فَجَهِلُوا أَنَّ ٠ِثْلَهَا يَنْبَغِي أَنْ يُحْرِ٠َا هِيَ حَتَّى قَدِ٠َكَّةَ وَهِيَ طَا٠ِثٌ حَلالٌ فَسَأَلُوا النَّاسَ فَقَالُوا تَخْرُجُ إِلَى بَعْضِ الْ٠َوَاقِيتِ فَتُحْرِ٠ِنْهُ وَكَانَتْ إِذَا فَعَلَتْ لَ٠ْ تُدْرِكِ الْحَجَّ فَسَأَلُوا أَبَا جَعْفَرٍ (عَلَيْهِ السَّلاَ٠َكَانِهَا قَدْ عَلِ٠َ الله نِيَّتَهَا.

They did not know that one like her must assume the state of Ihram; so they continued on their journey with her in the same condition, until they arrived in Makkah and she experienced Hayd (menses) and without Ihram. They asked people about it and they said that she must go to any one of Miqat to assume the state of Ihram; but in so doing she could not be in time for al-Hajj.

They asked abu Ja‘far (a.s.), and he (the Imam) said, ‘She must assume the state of Ihram from where she is, Allah had full knowledge of her intention.’” وثق - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (7/244))
