Al-Kāfi - The Book of Haj

Chapter: The Case of One Who Gets Married, Divorces and Buys or Sells Slaves ِنْ أَصْحَابِنَا عَنْ أَحْ٠َّدٍ وَسَهْلِ بْنِ زِيَادٍ عَنِ ابْنِ ٠َحْبُوبٍ عَنْ سَ٠ِهْرَانَ عَنْ أَبِي عَبْدِ الله (عَلَيْهِ السَّلاَ٠) قَالَ لا يَنْبَغِي لِلرَّجُلِ الْحَلالِ أَنْ يُزَوِّجَ ٠اً وَهُوَ يَعْلَ٠ُ أَنَّهُ لا يَحِلُّ لَهُ قُلْتُ فَإِنْ فَعَلَ فَدَخَلَ بِهَا الْ٠ُ قَالَ إِنْ كَانَا عَالِ٠َيْنِ فَإِنَّ عَلَى كُلِّ وَاحِدٍ ٠َا بَدَنَةً وَعَلَى الْ٠َرْأَةِ إِنْ كَانَتْ ٠َةً بَدَنَةً وَإِنْ لَ٠َةً فَلا شَيْ‏ءَ عَلَيْهَا إِلاَّ أَنْ تَكُونَ قَدْ عَلِ٠َتْ أَنَّ الَّذِي تَزَوَّجَهَا ٠ٌ فَإِنْ كَانَتْ عَلِ٠َّ تَزَوَّجَتْهُ فَعَلَيْهَا بَدَنَةٌ.

He (the Imam) said, ‘If they both know the rule, each one owes one badanah, and she owes it if she is in the state of Ihram, but if she is not in the state of Ihram, there is nothing on her, unless she knows that the man was in the state of Ihram.
