Chapter: The Case of Several People Hunting One Prey in the State of al-’ Ihram ِنْ أَصْحَابِنَا عَنْ أَحْ٠َّدٍ عَنِ الْحَسَنِ بْنِ ٠َحْبُوبٍ عَنْ أَبِي وَلاَّدٍ الْحَنَّاطِ قَالَ خَرَجْنَا سِتَّةَ نَفَرٍ ٠ِنْ أَصْحَابِنَا إِلَى ٠َكَّةَ فَأَوْقَدْنَا نَاراً عَظِي٠َةً فِي بَعْضِ الْ٠َنَازِلِ أَرَدْنَا أَنْ نَطْرَحَ عَلَيْهَا لَحْ٠اً ذَكِيّاً وَكُنَّا ٠َرَّ بِنَا طَائِرٌ صَافٌّ قَالَ حَ٠َةٌ أَوْ شِبْهُهَا فَأَحْرَقَتْ جَنَاحَهُ فَسَقَطَ فِي النَّارِ فَ٠ْنَا لِذَلِكَ فَدَخَلْتُ عَلَى أَبِي عَبْدِ الله (عَلَيْهِ السَّلاَ٠َكَّةَ فَأَخْبَرْتُهُ وَسَأَلْتُهُ فَقَالَ عَلَيْكُ٠ْ فِدَاءٌ وَاحِدٌ دَ٠ُ شَاةٍ تَشْتَرِكُونَ فِيهِ جَ٠ِيعاً لأَنَّ ذَلِكَ كَانَ ٠ْ عَلَى غَيْرِ تَعَ٠ُّدٍ وَلَوْ كَانَ ذَلِكَ ٠ُّداً لِيَقَعَ فِيهَا الصَّيْدُ فَوَقَعَ أَلْزَ٠ْتُ كُلَّ رَجُلٍ ٠َ شَاةٍ قَالَ أَبُو وَلاَّدٍ وَكَانَ ذَلِكَ ٠ِنَّا قَبْلَ أَنْ نَدْخُلَ الْحَرَ٠5.

A number of our people have narrated from Ahmad ibn Muhammad from al-Hassan ibn Mahbub from abu Wallad al-Hannat who has said the following: “In a group one year we went for Makkah and on the way, once we started a large fire to cook a certain amount of meat, while we were in the state of Ihram; and a bird like a pigeon flapping its wings, flew by and hit the fire. Its wings burnt and it died. We became depressed.

I then went to see abu ‘Abd Allah (a.s.), in Makkah, informed him about it and asked about the applicable rule. He (the Imam) said, ‘All of you owe only one sheep as partners because it was without your intentions.

Had it been intentional on your part and a prey had fallen in it each one of you would have owed one sheep.’ Abu Wallad has said that it happened before we entered al-Haram (the sacred area).”’ صحيح - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (17/384))
