Al-Kāfi - The Book of Commerce Chapter: Disputes Arising From al-Rahn (Security Deposit, Mortgage) َّدُ بْنُ يَحْيَى عَنْ ٠َّدِ بْنِ الْحُسَيْنِ عَنْ عَلِيِّ بْنِ الْحَكَ٠ِ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ ٠ٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلا٠) فِي رَجُلٍ يَرْهَنُ عِنْدَ صَاحِبِهِ رَهْناً لا بَيِّنَةَ بَيْنَهُ٠َا فِيهِ فَادَّعَى الَّذِي عِنْدَهُ الرَّهْنُ أَنَّهُ بِأَلْفٍ فَقَالَ صَاحِبُ الرَّهْنِ إِنَّ٠ِائَةٍ قَالَ الْبَيِّنَةُ عَلَى الَّذِي عِنْدَهُ الرَّهْنُ أَنَّهُ بِأَلْفٍ وَإِنْ لَ٠ْ يَكُنْ لَهُ بَيِّنَةٌ فَعَلَى الرَّاهِنِ الْيَ٠2.

Muhammad ibn Yahya has narrated from Muhammad ibn af-Husayn from Afi ibn ai-Hakam from ai-‘Ala’ ibn Razin from Muhammad ibn Musfim who has said the following: “It is the case of the parties of al-Rahn (security deposit) who dispute and there is no proof and testimony available for the parties involved. Al-Rahn (security deposit) holder claims it to be one thousand and the owner of al-Rahn (security deposit) claims it to be one hundred.

Abu Ja‘far (a.s.), has said, ‘Al-Rahn (security deposit) holder who claims it to be one thousand is required to present proof and testimony and if he fails then the other party takes an oath.’” صحيح - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (19/286))
