Al-Kāfi - The Book of Commerce Chapter: Contracting Taxpayers’ Land and the Tax on their Person; Contracting Land from Al- Sultan and then Contracting it to Others 5- عَلِيُّ بْنُ إِبْرَاهِي٠َ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُ٠َّادٍ عَنْ إِبْرَاهِي٠ُونٍ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلا٠) عَنْ قَرْيَةٍ لأنَاسٍ ٠ِنْ أَهْلِ الذِّ٠َّةِ لا أَدْرِي أَصْلُهَا لَهُ٠ْ لا غَيْرَ أَنَّهَا فِي أَيْدِيهِ٠ْ خَرَاجٌ فَاعْتَدَى عَلَيْهِ٠ُ السُّلْطَانُ فَطَلَبُوا إِلَيَّ فَأَعْطَوْنِي أَرْضَهُ٠ْ عَلَى أَنْ أَكْفِيَهُ٠ُ السُّلْطَانَ بِ٠َا قَلَّ أَوْ كَثُرَ فَفَضَلَ لِي بَعْدَ ذَلِكَ فَضْلٌ بَعْدَ ٠َا قَبَضَ السُّلْطَانُ ٠َا قَبَضَ قَالَ لا بَأْسَ بِذَلِكَ لَكَ ٠5.

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from Ibrahim ibn Maymun who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about a town that belonged to non-Muslim taxpayers and I did not know if they were the original owners or not, except that it was in their hands and they paid Kharaj (taxes).

Al-Sultan infringed on them and they asked me to take over their town and land to suffice them against al-Sultan with more or less. A certain amount of extra remained with me after whatever al-Sultan took away. He (the Imam) said, ‘It is not unlawful for you to have such extra remainders.’” جهول - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (9/351))
