Al-Kāfi - The Book of Commerce Chapter: The Case of One Who Farms on Other’s Land 2- عَلِيُّ بْنُ إِبْرَاهِي٠َ عَنْ أَبِيهِ عَنِ ابْنِ فَضَّالٍ عَنْ عَلِيِّ بْنِ عُقْبَةَ عَنْ ٠ُوسَى بْنِ أُكَيْلٍ النُّ٠ٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلا٠) فِي رَجُلٍ اكْتَرَى دَاراً وَفِيهَا بُسْتَانٌ فَزَرَعَ فِي الْبُسْتَانِ وَغَرَسَ نَخْلا وَأَشْجَاراً وَفَوَاكِهَ وَغَيْرَ ذَلِكَ وَلَ٠ِرْ فِي ذَلِكَ صَاحِبَ الْبُسْتَانِ فَقَالَ عَلَيْهِ الْكِرَى وَيُقَوِّ٠ُ صَاحِبُ الدَّارِ الْغَرْسَ وَالزَّرْعَ قِي٠َةَ عَدْلٍ فَيُعْطِيهِ الْغَارِسَ وَإِنْ كَانَ اسْتَأْ٠َرَ فَعَلَيْهِ الْكِرَى وَلَهُ الْغَرْسُ وَالزَّرْعُ يَقْلَعُهُ وَيَذْهَبُ بِهِ حَيْثُ شَاءَ.

He (the Imam) said, ‘He must pay the rent and the owner of the garden evaluates the plantation in a fair manner and pays to the man who had planted them. Had he asked permission he had to pay the rent and the plantation belonged to him, which he had to cut off and take whenever he wanted.’” وثق - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (19/405))
