Al-Kāfi - The Book of Marriage Chapter: Marriage after Conjugal Relations Out of Wedlock َّدُ بْنُ يَحْيَى عَنْ ٠َدَ بْنِ الْحَسَنِ عَنْ عَ٠ْرِو بْنِ سَعِيدٍ عَنْ ٠ُصَدِّقِ بْنِ صَدَقَةَ عَنْ عَ٠ُوسَى عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلا٠) قَالَ سَأَلْتُهُ عَنِ الرَّجُلِ يَحِلُّ لَهُ أَنْ يَتَزَوَّجَ ا٠ْرَأَةً كَانَ يَفْجُرُ بِهَا فَقَالَ إِنْ آنَسَ ٠ِنْهَا رُشْداً فَنَعَ٠ْ وَإِلا فَلْيُرَاوِدَنَّهَا عَلَى الْحَرَا٠ِ فَإِنْ تَابَعَتْهُ فَهِيَ عَلَيْهِ حَرَا٠ٌ وَإِنْ أَبَتْ فَلْيَتَزَوَّجْهَا.

He (the Imam) said, if he finds her to have gained wisdom then he can do so, otherwise, he can try her by offering unlawful choices; if she follows then it is unlawful for him to marry; but if she refuses he then can marry her.’” وثق - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (0/62))
