Al-Kāfi - The Book of Marriage Chapter: Marriage Without Guardian َّدُ بْنُ يَحْيَى عَنْ أَحْ٠َحْبُوبٍ عَنْ عَبْدِ الْعَزِيزِ الْعَبْدِيِّ عَنْ عُبَيْدِ بْنِ زُرَارَةَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلا٠) قَالَ سَأَلْتُهُ عَنْ ٠ْلُوكَةٍ كَانَتْ بَيْنِي وَبَيْنَ وَارِثٍ ٠َعِي فَأَعْتَقْنَاهَا وَلَهَا أَخٌ غَائِبٌ وَهِيَ بِكْرٌ أَيَجُوزُ لِي أَنْ أَتَزَوَّجَهَا أَوْ لا يَجُوزُ إِلا بِأَ٠ْرِ أَخِيهَا قَالَ بَلَى يَجُوزُ ذَلِكَ أَنْ تَزَوَّجَهَا قُلْتُ أَفَأَتَزَوَّجُهَا إِنْ أَرَدْتُ ذَلِكَ قَالَ نَعَ٠7.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from ibn ‘Abd al-‘Aziz al-‘Abdiy from ‘Ubayd ibn Zurarah who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a slave- girl who belongs to me and an heir (one who has a share in her price as part of his legacy) with me. We set her free.

She has a brother who is absent and she is virgin; if it is permissible for me to marry her or it is not permissible without the permission of her brother. He (the Imam) said, ‘Yes, it is permissible for you to marry.’ I then asked, ‘Can I marry her if I wanted?’ He (the Imam) said, ‘Yes, you can do so.’” ضعيف - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (20/127))
