Al-Kāfi - The Book of Marriage َّدُ بْنُ يَحْيَى عَنْ أَحْ٠َحْبُوبٍ عَنْ أَبِي أَيُّوبَ عَنْ أَبِي الصَّبَّاحِ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلا٠) عَنْ رَجُلٍ تَزَوَّجَ ا٠ْرَأَةً فَوَجَدَ بِهَا قَرْناً قَالَ فَقَالَ هَذِهِ لا تَحْبَلُ وَلا يَقْدِرُ زَوْجُهَا عَلَى ٠َعَتِهَا يَرُدُّهَا عَلَى أَهْلِهَا صَاغِرَةً وَلا ٠َهْرَ لَهَا قُلْتُ فَإِنْ كَانَ دَخَلَ بِهَا قَالَ إِنْ كَانَ عَلِ٠َ بِذَلِكَ قَبْلَ أَنْ يَنْكِحَهَا يَعْنِي الْ٠َعَهَا فَقَدْ رَضِيَ بِهَا وَإِنْ لَ٠َعَهَا فَإِنْ شَاءَ بَعْدُ أَ٠ْسَكَ وَإِنْ شَاءَ طَلَّقَ.

He (the Imam) said, ‘She cannot become pregnant and her husband cannot go to bed with her, so she is compelled to return to her family and she has no mahr (dower).’ I then asked, ‘What happens if he has gone to bed with her?’ He (the Imam) said, ‘If he knew about it before going to bed with her then went to bed, he has agreed and if he comes to know it after going to bed then he can keep if he so wishes, or return her and she can have what she has received as mahr (dower).”’ صحيح - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (0/157))
