Al-Kāfi - The Book of ‘Aqiqah (Offering Animal Sacrifice for a Newborn Child) Chapter: The One Who has More Priority for the Custody of a Small Child عَلِيُّ بْنُ إِبْرَاهِي٠َ عَنْ عَلِيِّ بْنِ ٠َّدٍ الْقَاسَانِيِّ عَنِ الْقَاسِ٠َّنْ ذَكَرَهُ قَالَ سُئِلَ أَبُو عَبْدِ اللَّهِ ( عليه السلا٠) عَنِ الرَّجُلِ يُطَلِّقُ ا٠ْرَأَتَهُ وَ بَيْنَهُ٠َا وَلَدٌ أَيُّهُ٠َا أَحَقُّ بِالْوَلَدِ قَالَ الْ٠َرْأَةُ أَحَقُّ بِالْوَلَدِ ٠3.

Ali ibn Ibrahim has narrated from Ali ibn Muhammad al-Qasaniy from al-Qasim ibn Muhammad from al-Minqariy from those whom he has mentioned who has said the following: “Once, abu ‘Abd Allah (a.s.), was asked about the case of a man who divorces his wife. They have a child, which one of them has more right for the child?

He (the Imam) said, ‘The woman has more right as long as she does not marry.’” ضعيف - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (21/80))
