A divorce is not according to Sunnah if it is not pronounced in the presence of two just witnesses, in a menses-free period in which the husband has not gone to bed with her. If a man divorces his wife in a menses-free period during which he has not gone to bed with her but it is not in presence (of two just) witnesses, such divorce is not a valid divorce.
If a man divorces his wife according to Sunnah, in a menses-free period in which he has not gone to bed with her and pronounces it in the presence of witnesses but has not intended it to be a divorce it also is not a valid divorce.ââ Ø¬ÙÙÙ - Allamah Baqir al-Majlisi (MirʾÄt al-Ê¿UqÅ«l fÄ« Sharḥ AkhbÄr Äl al-RasÅ«l (1/105))
