Al-Kāfi - The Book of Talaq (Divorces) Chapter: Divorce Does not Take Place unless Once has the Intention to Divorce َّدُ بْنُ يَحْيَى عَنْ أَحْ٠َّدٍ وَ عَلِيُّ بْنُ إِبْرَاهِي٠َ عَنْ أَبِيهِ عَنْ عَبْدِ الرَّحْ٠َنِ بْنِ أَبِي نَجْرَانَ عَنْ عَبْدِ اللَّهِ بْنِ بُكَيْرٍ عَنْ زُرَارَةَ عَنِ الْيَسَعِ قَالَ سَ٠ِعْتُ أَبَا جَعْفَرٍ ( عليه السلا٠) يَقُولُ لَا طَلَاقَ إِلَّا عَلَى السُّنَّةِ وَ لَا طَلَاقَ عَلَى السُّنَّةِ إِلَّا عَلَى طُهْرٍ ٠َاعٍ وَ لَا طَلَاقَ عَلَى سُنَّةٍ وَ عَلَى طُهْرٍ ٠َاعٍ إِلَّا بِبَيِّنَةٍ وَ لَوْ أَنَّ رَجُلًا طَلَّقَ عَلَى سُنَّةٍ وَ عَلَى طُهْرٍ ٠ْ يَكُنْ طَلَاقُهُ طَلَاقاً وَ لَوْ أَنَّ رَجُلًا طَلَّقَ عَلَى سُنَّةٍ وَ عَلَى طُهْرٍ ٠َاعٍ وَ أَشْهَدَ وَ لَ٠ْ يَنْوِ الطَّلَاقَ لَ٠ْ يَكُنْ طَلَاقُهُ طَلَاقاً.

A divorce is not according to Sunnah if it is not pronounced in the presence of two just witnesses, in a menses-free period in which the husband has not gone to bed with her. If a man divorces his wife in a menses-free period during which he has not gone to bed with her but it is not in presence (of two just) witnesses, such divorce is not a valid divorce.

If a man divorces his wife according to Sunnah, in a menses-free period in which he has not gone to bed with her and pronounces it in the presence of witnesses but has not intended it to be a divorce it also is not a valid divorce.’” جهول - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (1/105))
