ভূমিকা

َّدُ بْنُ يَحْيَى عَنْ أَحْ٠َحْبُوبٍ عَنِ الْحَسَنِ بْنِ صَالِحٍ قَالَ سَأَلْتُ جَعْفَرَ بْنَ ٠َّدٍ ( عليه السلا٠) عَنْ رَجُلٍ طَلَّقَ ا٠ْرَأَتَهُ وَ هُوَ غَائِبٌ فِي بَلْدَةٍ أُخْرَى وَ أَشْهَدَ عَلَى طَلَاقِهَا رَجُلَيْنِ ثُ٠َّ إِنَّهُ رَاجَعَهَا قَبْلَ انْقِضَاءِ الْعِدَّةِ وَ لَ٠ْ يُشْهِدْ عَلَى الرَّجْعَةِ ثُ٠َ عَلَيْهَا بَعْدَ انْقِضَاءِ الْعِدَّةِ وَ قَدْ تَزَوَّجَتْ رَجُلًا فَأَرْسَلَ إِلَيْهَا أَنِّي قَدْ كُنْتُ رَاجَعْتُكِ قَبْلَ انْقِضَاءِ الْعِدَّةِ وَ لَ٠ْ أُشْهِدْقَالَ فَقَالَ لَا سَبِيلَ لَهُ عَلَيْهَا لِأَنَّهُ قَدْ أَقَرَّ بِالطَّلَاقِ وَ ادَّعَى الرَّجْعَةَ بِغَيْرِ بَيِّنَةٍ فَلَا سَبِيلَ لَهُ عَلَيْهَا وَ لِذَلِكَ يَنْبَغِي لِ٠َنْ طَلَّقَ أَنْ يُشْهِدَ وَ لِ٠َنْ رَاجَعَ أَنْ يُشْهِدَ عَلَى الرَّجْعَةِ كَ٠َا أَشْهَدَ عَلَى الطَّلَاقِ وَ إِنْ كَانَ قَدْ أَدْرَكَهَا قَبْلَ أَنْ تَزَوَّجَ كَانَ خَاطِباً ٠ِنَ الْخُطَّابِ . 4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from al-Hassan ibn Salih who has said the following: “I once asked abu Ja‘far (a.s.), about the case of a man who divorces his wife when he is absent from her. He is in another city and has two men as witness about his divorce; then he goes back to her without witness. After expiration of waiting period he comes and finds out that she has married another man. He sends a message to her informing her about his revoking the divorce before the expiration of waiting period without witnesses. He (the narrator) has said that he (the Imam) said, ‘He has no way to her because he has confirmed divorce and has claimed revocation without witness, thus, he has no way to her.
