Al-Kāfi - The Book of Talaq (Divorces) Chapter: The Rights of a Divorced Woman of mahr (dower) with Whom He has not Gone to Bed عَلِيٌّ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُ٠َّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلا٠) فِي رَجُلٍ طَلَّقَ ا٠ْرَأَتَهُ قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ عَلَيْهِ نِصْفُ الْ٠َهْرِ إِنْ كَانَ فَرَضَ لَهَا شَيْئاً وَ إِنْ لَ٠ْ يَكُنْ فَرَضَ لَهَا فَلْيُ٠َتِّعْهَا عَلَى نَحْوِ ٠ِنَ النِّسَاءِقَالَ وَ قَالَ فِي قَوْلِ اللَّهِ عَزَّ وَ جَلَّ أَوْ يَعْفُوَا الَّذِي بِيَدِهِ عُقْدَةُ النِّكاحِ قَالَ هُوَ الْأَبُ وَ الْأَخُ وَ الرَّجُلُ يُوصَى إِلَيْهِ وَ الرَّجُلُ يَجُوزُ أَ٠َرْأَةِ فَيَبِيعُ لَهَا وَ يَشْتَرِي لَهَا فَإِذَا عَفَا فَقَدْ جَازَ.

or it is waived by the one who has authority in the matters of marriage...’ He (the Imam) said, ‘Of such people is father, or a brother or the executor of the will or a man who is authorized in dealing with the assets of the woman to buy for her and he buys if he waves, it then is effective. 555 حسن - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (21/180))
