Al-Kāfi - The Book of Talaq (Divorces) Chapter: The Rights of a Divorced Woman of mahr (dower) with Whom He has not Gone to Bed عَلِيٌّ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُ٠َيْرٍ عَنِ ابْنِ بُكَيْرٍ عَنْ عُبَيْدِ بْنِ زُرَارَةَ قَالَ قُلْتُ لِأَبِي عَبْدِ اللَّهِ ( عليه السلا٠) رَجُلٌ تَزَوَّجَ ا٠َّ سَاقَ إِلَيْهَا الْغَنَ٠َّ طَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا وَ قَدْ وَلَدَتِ الْغَنَ٠ُ قَالَ إِنْ كَانَتِ الْغَنَ٠َلَتْ عِنْدَهُ رَجَعَ بِنِصْفِهَا وَ نِصْفِ أَوْلَادِهَا وَ إِنْ لَ٠ْلُ عِنْدَهُ رَجَعَ بِنِصْفِهَا وَ لَ٠ِنَ الْأَوْلَادِ بِشَيْ‏ءٍ.٠َّدُ بْنُ يَحْيَى عَنْ أَحْ٠َّدٍ عَنِ ابْنِ فَضَّالٍ عَنِ ابْنِ بُكَيْرٍ عَنْ عُبَيْدِ بْنِ زُرَارَةَ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلا٠ِثْلَهُ إِلَّا أَنَّهُ قَالَ سَاقَ إِلَيْهَا غَنَ٠اً وَ رَقِيقاً فَوَلَدَتِ الْغَنَ٠4.

Ali has narrated from his father from Ibn Abi ‘Umayr from ibn Bukayr from ‘Ubayd ibn Zurarah who has said the following: “I once asked abu ‘Abd Allah (a.s.), about the case of a man who marries a woman and sets a mahr (dower) of one hundred sheep. He then delivers them to her, then divorces her before going to bed with her and the sheep have given birth to their young.

He (the Imam) said, ‘If the sheep had become pregnant with him she must return one-half of them and one-half of the young ones; but if they did not become pregnant with him she must return one-half of the sheep but not the young ones.

555 Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from ibn Bukayr from ‘Ubayd ibn Zurarah who has narrated the following: “He has narrated a similar Hadith from abu ‘Abd Allah (a.s.), except that he has said, ‘He delivered sheep and slaves, then sheep and slaves gave birth. 555 وثق - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (1/181))
