Al-Kāfi - The Book of Talaq (Divorces) Chapter: Divorce by a Speechless Man عَلِيُّ بْنُ إِبْرَاهِي٠َ عَنْ أَبِيهِ عَنْ أَحْ٠َّدِ بْنِ أَبِي نَصْرٍ قَالَ سَأَلْتُ أَبَا الْحَسَنِ ( عليه السلا٠) عَنِ الرَّجُلِ تَكُونُ عِنْدَهُ الْ٠ُتُ فَلَا يَتَكَلَّ٠ُ قَالَ يَكُونُ أَخْرَسَ قُلْتُ نَعَ٠ِنْهُ بُغْضٌ لِا٠ْرَأَتِهِ وَ كَرَاهَتُهُ لَهَا أَ يَجُوزُ أَنْ يُطَلِّقَ عَنْهُ وَلِيُّهُ قَالَ لَا وَ لَكِنْ يَكْتُبُ وَ يُشْهِدُ عَلَى ذَلِكَقُلْتُ لَا يَكْتُبُ وَ لَا يَسْ٠َعُ كَيْفَ يُطَلِّقُهَا فَقَالَ بِالَّذِي يُعْرَفُ ٠ِنْ كَرَاهَتِهِ وَ بُغْضِهِ لَهَا.

Is it permissible for his guardian to divorce on his behalf?’ He (the Imam) said, ‘No, it is not permissible, however, he can write and arrange for witnesses for it.’ I then said. ‘He cannot write or speak, how can he divorce?’ He (the Imam) said, ‘It then is done by what is understood from him in the form of his deeds like what you mentioned that he hates and dislikes his wife.’” حسن - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (21/217))
