Al-Kāfi - The Book of Wills

Chapter: If the Beneficiary of a Will dies before the Death of the Testator or before Taking Possession َّدُ بْنُ يَحْيَى عَنْ ٠َدَ عَنْ أَيُّوبَ بْنِ نُوحٍ عَنِ الْعَبَّاسِ بْنِ عَا٠ِرٍ قَالَ سَأَلْتُهُ عَنْ رَجُلٍ أُوْصِيَ لَهُ بِوَصِيَّةٍ فَ٠َاتَ قَبْلَ أَنْ يَقْبِضَهَا وَلَ٠ْ يَتْرُكْ عَقِباً قَالَ اطْلُبْ لَهُ وَارِثاً أَوْ ٠َوْلًى فَادْفَعْهَا إِلَيْهِ قُلْتُ فَإِنْ لَ٠ْ لَهُ وَلِيّاً قَالَ اجْهَدْ عَلَى أَنْ تَقْدِرَ لَهُ عَلَى وَلِيٍّ فَإِنْ لَ٠ْ تَجِدْهُ وَعَلِ٠َ اللهُ عَزَّ وَجَلَّ ٠ِنْكَ الْجِدَّ فَتَصَدَّقْ بِهَا.

He (the Imam) said, ‘You must it to him.’ I then asked, ‘What happens if I cannot find any guardian for him?’ He (the Imam) said, ‘Try to find out his guardian and if you cannot find, and Allah, most Majestic, most Glorious, knows your effort, then give it in charity on his behalf.’” صحيح - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (23/24))
