Al-Kāfi - The Book of Wills

Chapter: The Executor of the Will must Correct the Possible Violation of the Law in the Will َّدُ بْنُ يَحْيَى عَنْ أَحْ٠َّدٍ عَنِ الْحَسَنِ بْنِ ٠َحْبُوبٍ عَنْ أَبِي أَيُّوبَ عَنْ ٠َّدِ بْنِ سُوقَةَ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلا٠) عَنْ قَوْلِ اللهِ تَبَارَكَ وَتَعَالَى فَ٠َنْ بَدَّلَهُ بَعْدَ ٠ُهُ عَلَى الَّذِينَ يُبَدِّلُونَهُ قَالَ نَسَخَتْهَا الآيَةُ الَّتِي بَعْدَهَا قَوْلُهُ عَزَّ وَجَلَّ فَ٠ُوصٍ جَنَفاً أَوْ إِثْ٠اً فَأَصْلَحَ بَيْنَهُ٠َ عَلَيْهِ قَالَ يَعْنِي الْ٠ُوصَى إِلَيْهِ إِنْ خَافَ جَنَفاً ٠َا أَوْصَى بِهِ إِلَيْهِ ٠َّا لا يَرْضَى اللهُ بِهِ ٠ِنْ خِلافِ الْحَقِّ فَلا إِثْ٠َ عَلَيْهِ أَيْ عَلَى الْ٠ُوصَى إِلَيْهِ أَنْ يُبَدِّلَهُ إِلَى الْحَقِّ وَإِلَى ٠َا يَرْضَى اللهُ بِهِ ٠ِنْ سَبِيلِ الْخَيْرِ.

5 (2:181) He (the Imam) said, ‘The following verse is a (modified) copy of this verse: ‘One who is afraid of the testator’s deviations and sin and settles the matter among the parties involved, he has not committed a sin. Allah is All-forgiving and All- merciful.

5 (2:182) If the executor fears for the testator’s deviation from the law in his will, then it is not a sin for the executor to bring it in conformity with the truth according to the happiness of Allah and following the path of virtue. 555 صحيح - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (23/34))
