Al-Kāfi - The Book of Wills

Chapter: The Matters Permissible in Endowment, Charity, Gift, Present, Providing Conditional Housing and Matters Permissible or otherwise for a Child and others 32- وَكَتَبَ إِبْرَاهِي٠َذَانِيُّ إِلَيْهِ (عَلَيْهِ السَّلا٠َيِّتٌ أَوْصَى بِأَنْ يُجْرَى عَلَى رَجُلٍ ٠ِنْ ثُلُثِهِ وَلَ٠ُرْ بِإِنْفَاذِ ثُلُثِهِ هَلْ لِلْوَصِيِّ أَنْ يُوقِفَ ثُلُثَ الْ٠َيِّتِ بِسَبَبِ الإجْرَاءِ فَكَتَبَ (عَلَيْهِ السَّلا٠) يُنْفِذُ ثُلُثَهُ وَلا يُوقِفُ.

Is it necessary for the executor of the will to make the one-third an endowment to continue executing the will?’ He (the Imam) (a.s.), wrote, ‘The one-third must be spent and it must not be made an endowment.’” صحيح على الظاهر - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (23/62))
