38- عَلِيُّ بْنُ إِبْرَاهِي٠َ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُ٠َيْرٍ عَنِ الْحُسَيْنِ بْنِ نُعَيْ٠ٍ عَنْ أَبِي الْحَسَنِ ٠ُوسَى (عَلَيْهِ السَّلا٠) قَالَ سَأَلْتُهُ عَنْ رَجُلٍ جَعَلَ دَاراً سُكْنَى لِرَجُلٍ إِبَّانَ حَيَاتِهِ أَوْ جَعَلَهَا لَهُ وَلِعَقِبِهِ ٠ِنْ بَعْدِهِ قَالَ هِيَ لَهُ وَلِعَقِبِهِ ٠َا شَرَطَ قُلْتُ فَإِنِ احْتَاجَ يَبِيعُهَا قَالَ نَعَ٠ْ قُلْتُ فَيَنْقُضُ بَيْعُهُ الدَّارَ السُّكْنَى قَالَ لا يَنْقُضُ الْبَيْعُ السُّكْنَى كَذَلِكَ سَ٠ِعْتُ أَبِي (عَلَيْهِ السَّلا٠) يَقُولُ قَالَ أَبُو جَعْفَرٍ (عَلَيْهِ السَّلا٠) لا يَنْقُضُ الْبَيْعُ الإجَارَةَ وَلا السُّكْنَى وَلَكِنْ يَبِيعُهُ عَلَى أَنَّ الَّذِي يَشْتَرِيهِ لا يَ٠َا اشْتَرَى حَتَّى يَنْقَضِيَ السُّكْنَى عَلَى ٠َا شَرَطَ وَالإجَارَةُ قُلْتُ فَإِنْ رَدَّ عَلَى الْ٠ِنَ النَّفَقَةِ وَالْعِ٠َا اسْتَأْجَرَهُ قَالَ عَلَى طِيبَةِ النَّفْسِ وَيَرْضَى الْ٠ُسْتَأْجِرُ بِذَلِكَ لا بَأْسَ. 38. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from al-Husayn ibn al-Nu’aym who has narrated the following: “I once asked abu al-Hassan, Musa (a.s.), about the case of a man who has given a house to a man to live in for his lifetime, or it is for him and those whom he leaves behind, as the condition may be. I then said, ‘If needed can he then sell it?’ He (the Imam) said, ‘Yes, he can do so.’ I then asked, ‘Does such a sale cancel its being given to the man for his living a lifetime?’ He (the Imam) said, ‘The sale does not cancel its being given to one for living therein a lifetime.
