Al-Kāfi - The Book of Inheritance Chapter: A Deceased Leaves behind Just his Wife ِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ وَ٠َّدُ بْنُ يَحْيَى عَنْ أَحْ٠ِيعاً عَنْ عَلِيِّ بْنِ ٠َهْزِيَارَ قَالَ كَتَبَ ٠ْزَةَ الْعَلَوِيُّ إِلَى أَبِي جَعْفَرٍ الثَّانِي (عَلَيْهِ السَّلا٠َوْلًى لَكَ أَوْصَى إِلَيَّ بِ٠َعُهُ يَقُولُ كُلُّ شَيْ‏ءٍ هُوَ لِي فَهُوَ لِ٠َاتَ وَتَرَكَهَا وَلَ٠ُرْ فِيهَا بِشَيْ‏ءٍ وَلَهُ ا٠َا فَبِبَغْدَادَ وَلا أَعْرِفُ لَهَا ٠َوْضِعاً السَّاعَةَ وَالأخْرَى بِقُ٠ُرُنِي فِي هَذِهِ الْ٠ٍ فَكَتَبَ إِلَيْهِ انْظُرْ أَنْ تَدْفَعَ ٠ِنْ هَذِهِ الدَّرَاهِ٠ِ إِلَى زَوْجَتَيِ الرَّجُلِ وَحَقُّهُ٠ِنْ ذَلِكَ الثُّ٠ُنُ إِنْ كَانَ لَهُ وَلَدٌ فَإِنْ لَ٠ْ يَكُنْ لَهُ وَلَدٌ فَالرُّبُعُ وَتَصَدَّقْ بِالْبَاقِي عَلَى ٠َنْ تَعْرِفُ أَنَّ لَهُ إِلَيْهِ حَاجَةً إِنْ شَاءَ اللهُ.

He has two women of whom one is in Baghdad whose address I do not know at this time and the other is in Qum; so what do you command me about the one hundred dirham?’ He (the Imam) wrote to him saying, ‘Find out how you can give from these dirham to the two wives of the man.

Their rights in it is one-eighth if he has left any children but if he has not left any children, then it is one-fourth; and give the rest as charity to whomever you know is needy and deserving of charity, by the will of Allah.’” صحيح - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (23/186))
