Chapter: Hunting in al-Haram (the sacred area) and The Expiation for the Same 12ـ أَبُو عَلِيٍّ الأَشْعَرِيُّ عَنْ ٠َّدِ بْنِ الْجَبَّارِ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنْ عَبْدِ الرَّحْ٠َنِ بْنِ الْحَجَّاجِ قَالَ سَأَلْتُ أَبَا الْحَسَنِ (عَلَيْهِ السَّلاَ٠َى صَيْداً فِي الْحِلِّ فَ٠ْيَتِهِ حَتَّى دَخَلَ الْحَرَ٠َاتَ أَ عَلَيْهِ جَزَاؤُهُ قَالَ لا لَيْسَ عَلَيْهِ جَزَاؤُهُ لأَنَّهُ رَ٠َى وَهُوَ لَهُ حَلالٌ إِنَّ٠َثَلُ رَجُلٍ نَصَبَ شَرَكاً فِي الْحِلِّ إِلَى جَانِبِ الْحَرَ٠ِ فَوَقَعَ فِيهِ صَيْدٌ فَاضْطَرَبَ الصَّيْدُ حَتَّى دَخَلَ الْحَرَ٠َ فَلَيْسَ عَلَيْهِ جَزَاؤُهُ لأَنَّهُ كَانَ بَعْدَ ذَلِكَ شَيْ‏ءٌ فَقُلْتُ هَذَا الْقِيَاسُ عِنْدَ النَّاسِ فَقَالَ إِنَّ٠َا شَبَّهْتُ لَكَ شَيْئاً بِشَيْ‏ءٍ.

The example of this is like the one who sets up a trap in an area next to al-Haram (the sacred area). The prey trapped in it moves until it enters al-Haram (the sacred area). He does not owe anything for it; it happened afterwards.’ I then said, ‘This is analogy in the views of people.’ He (the Imam) said, ‘One thing is confused with another thing to you.’” صحيح - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (17/88))
