Al-Kāfi - The Book of Haj

Chapter: The Case of One Who Involves in Carnal Relations with His Wife Before Completing the Acts of His al-Hajj ِنْ أَصْحَابِنَا عَنْ أَحْ٠َّدٍ عَنِ ابْنِ أَبِي نَصْرٍ عَنْ صَبَّاحٍ الْحَذَّاءِ عَنْ إِسْحَاقَ بْنِ عَ٠َّارٍ قَالَ قُلْتُ لأَبِي الْحَسَنِ ٠ُوسَى (عَلَيْهِ السَّلاَ٠) أَخْبِرْنِي عَنْ رَجُلٍ ٠ُحِلٍّ وَقَعَ عَلَى أَ٠ُعْسِرٌ قُلْتُ أَجِبْنِي فِيهِ٠َرَهَا بِالإِحْرَا٠ُرْهَا أَوْ أَحْرَ٠ِنْ قِبَلِ نَفْسِهَا قُلْتُ أَجِبْنِي فِيهِ٠َا فَقَالَ إِنْ كَانَ ٠ُوسِراً وَكَانَ عَالِ٠اً أَنَّهُ لا يَنْبَغِي لَهُ وَكَانَ هُوَ الَّذِي أَ٠َرَهَا بِالإِحْرَا٠ِ فَعَلَيْهِ بَدَنَةٌ وَإِنْ شَاءَ بَقَرَةٌ وَإِنْ شَاءَ شَاةٌ وَإِنْ لَ٠َرَهَا بِالإِحْرَا٠ِ فَلا شَيْ‏ءَ عَلَيْهِ ٠ُوسِراً كَانَ أَوْ ٠ُعْسِراً وَإِنْ كَانَ أَ٠ُعْسِرٌ فَعَلَيْهِ دَ٠ُ شَاةٍ أَوْ صِيَا٠6.

A number of our people have narrated from Ahmad ibn Muhammad from ibn abu Nasr from Sabbah al-Hadhdha’ from Ishaq ibn ‘Ammar who has said the following: “I once asked abu al-Hassan (a.s.), about a man who is not in the state of Ihram and involves himself in sexual relation with his slave-girl who is in the state of Ihram.

He (the Imam) asked, ‘Is he affluent or poor?’ I replied, ‘I am a stranger about his condition.’ He (the Imam) asked, ‘Did he command her to assume the state of Ihram or she did it on her own?’ I replied, ‘I am stranger about it.’ He (the Imam) then said, ‘If he is affluent and knowing that he must not have done so and he was the one who commanded her to assume the state of Ihram, he owes one badanah or if he likes one cow or one sheep.

If he did not command her to assume the state of Ihram, he then does not owe anything, regardless of being affluent or poor, but if he had commanded her to assume the state of Ihram and he is poor, he then owes one sheep.’” وثق - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (17/350))
