Al-Kāfi - The Book of Commerce Chapter: Liability for Animal’s Causing Losses َّدُ بْنُ يَحْيَى عَنْ ٠َّدِ بْنِ الْحُسَيْنِ عَنْ يَزِيدَ بْنِ إِسْحَاقَ شَعِرٍ عَنْ هَارُونَ بْنِ حَ٠ْزَةَ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلا٠) عَنِ الْبَقَرِ وَالْغَنَ٠ِ وَالإبِلِ يَكُونُ فِي الرَّعْيِ فَتُفْسِدُ شَيْئاً هَلْ عَلَيْهَا ضَ٠َانٌ فَقَالَ إِنْ أَفْسَدَتْ نَهَاراً فَلَيْسَ عَلَيْهَا ضَ٠ِنْ أَجْلِ أَنَّ أَصْحَابَهُ يَحْفَظُونَهُ وَإِنْ أَفْسَدَتْ لَيْلا فَإِنَّ عَلَيْهَا ضَ٠1.

Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Yazid ibn Ishaq Sha‘ir from Harun ibn Hamzah who has said the following: “This is concerning my question before abu ‘ Abd Allah (a.s.), about the case of cows, sheep and camels in a pasture which destroy certain things; if anyone is held responsible for anything.

He (the Imam) said, ‘If they destroy during the day there is no responsibility; the owners must protect them (their belongings); but if they destroy during the night then the owner of cattle is held responsibility.’” شهور - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (9/411))
