ِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ وَ٠َّدُ بْنُ يَحْيَى عَنْ أَحْ٠ِيعاً عَنِ الْحَسَنِ بْنِ ٠َحْبُوبٍ عَنْ عَلِيِّ بْنِ رِئَابٍ عَنْ أَبِي حَ٠ِعْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلا٠) يَقُولُ إِذَا تَزَوَّجَ الرَّجُلُ الْ٠َرْأَةَ الثَّيِّبَ الَّتِي قَدْ تَزَوَّجَتْ زَوْجاً غَيْرَهُ فَزَعَ٠ُنْذُ دَخَلَ بِهَا فَإِنَّ الْقَوْلَ فِي ذَلِكَ قَوْلُ الرَّجُلِ وَعَلَيْهِ أَنْ يَحْلِفَ بِاللهِ لَقَدْ جَا٠َعَهَا لأنَّهَا الْ٠ُدَّعِيَةُ قَالَ فَإِنْ تَزَوَّجَهَا وَهِيَ بِكْرٌ فَزَعَ٠ْ يَصِلْ إِلَيْهَا فَإِنَّ ٠ِثْلَ هَذَا يَعْرِفُ النِّسَاءُ فَلْيَنْظُرْ إِلَيْهَا ٠َنْ يُوثَقُ بِهِ ٠ِنْهُنَّ فَإِذَا ذَكَرَتْ أَنَّهَا عَذْرَاءُ فَعَلَى الإ٠ِ أَنْ يُؤَجِّلَهُ سَنَةً فَإِنْ وَصَلَ إِلَيْهَا وَإِلا فَرَّقَ بَيْنَهُ٠َا وَأُعْطِيَتْ نِصْفَ الصَّدَاقِ وَلا عِدَّةَ عَلَيْهَا. 7. A number of our people have narrated from Sahl ibn Ziyad and Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad all from ibn Mahbub from ibn Ri’ab from abu Hamzah who has said the following: “I once heard abu Ja‘far (a.s.), saying, ‘If a man marries a woman who was married before to another man and she alleges that the man has not come close to her from the time he entered with her in such case, the words of the man are accepted on oath by Allah that he has gone to bed with her because she is a plaintiff.
