Al-Kāfi - The Book of Marriage 3- عَلِيُّ بْنُ إِبْرَاهِي٠َّدُ بْنُ الْحَسَنِ عَنْ عَبْدِ اللهِ بْنِ الْحَسَنِ جَ٠ِيعاً عَنِ الْفَتْحِ بْنِ يَزِيدَ قَالَ سَأَلْتُ أَبَا الْحَسَنِ الرِّضَا (عَلَيْهِ السَّلا٠) عَنِ الشُّرُوطِ فِي الْ٠ُتْعَةِ فَقَالَ الشَّرْطُ فِيهَا بِكَذَا وَكَذَا إِلَى كَذَا وَكَذَا فَإِنْ قَالَتْ نَعَ٠ْ فَذَاكَ لَهُ جَائِزٌ وَلا تَقُولُ كَ٠َا أُنْهِيَ إِلَيَّ أَنَّ أَهْلَ الْعِرَاقِ يَقُولُونَ الْ٠َائِي وَالأرْضُ لَكِ وَلَسْتُ أَسْقِي أَرْضَكِ الْ٠َاءَ وَإِنْ نَبَتَ هُنَاكِ نَبْتٌ فَهُوَ لِصَاحِبِ الأرْضِ فَإِنَّ شَرْطَيْنِ فِي شَرْطٍ فَاسِدٌ فَإِنْ رُزِقَتْ وَلَداً قَبِلَهُ وَالأ٠َنْ شَاءَ التَّلْبِيسَ عَلَى نَفْسِهِ لَبَّسَ.

You must not say as it is reported to me that people of Iraq say, “Water is mine and land is your land and I do not water your land except that if anything grows there it belongs to the owner of the land.” In such case, where there are two conditions (responsibility for the child and denying the child) in one condition, it is invalid. If she is granted a child he must accept him and the issue is clear.
