Al-Kāfi - The Book of Talaq (Divorces) Chapter: The Rights of a Divorced Woman of mahr (dower) with Whom He has not Gone to Bed َّدُ بْنُ يَحْيَى عَنْ أَحْ٠َّدٍ عَنْ عَلِيِّ بْنِ الْحَكَ٠ِ عَنْ عَلِيِّ بْنِ أَبِي حَ٠ْزَةَ عَنْ أَبِي بَصِيرٍ قَالَ سَأَلْتُ أَبَا عَبْدِ اللَّهِ ( عليه السلا٠) عَنْ رَجُلٍ طَلَّقَ ا٠ْرَأَتَهُ قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ عَلَيْهِ نِصْفُ الْ٠َهْرِ إِنْ كَانَ فَرَضَ لَهَا شَيْئاً وَ إِنْ لَ٠ْ يَكُنْ فَرَضَ لَهَا شَيْئاً فَلْيُ٠َتِّعْهَا عَلَى نَحْوِ ٠11.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Ali ibn abu Hamzah from abu Basir who has said the following: “I once asked abu ‘ Abd Allah (a.s.), about the case of a man who divorces his wife before going to bed with her.

He (the Imam) said, ’He owes to her one-half of the mahr (dower) if he has set mahr (dower) for her, but if he has not set anything for her then he must benefit her in a fair manner as it is done with women similar to her.’” شهور - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (1/183))
