Al-Kāfi - The Book of Talaq (Divorces) Chapter: Divorce and Marriage during one’s Illness َّدُ بْنُ يَحْيَى عَنْ أَحْ٠َحْبُوبٍ عَنِ ابْنِ بُكَيْرٍ عَنْ عُبَيْدِ بْنِ زُرَارَةَ قَالَ سَأَلْتُ أَبَا عَبْدِ اللَّهِ ( عليه السلا٠َرِيضِ أَ لَهُ أَنْ يُطَلِّقَ ا٠ْرَأَتَهُ فِي تِلْكَ الْحَالِ قَالَ لَا وَ لَكِنْ لَهُ أَنْ يَتَزَوَّجَ إِنْ شَاءَ فَإِنْ دَخَلَ بِهَا وَرِثَتْهُ وَ إِنْ لَ٠ْ يَدْخُلْ بِهَا فَنِكَاحُهُ بَاطِلٌ.

He (the Imam) said, ‘No, he cannot divorce, however, he can marry if he wants and if he goes to bed with her, she inherits his legacy but if he did not go to bed with her his marriage is invalid.’” وثق كالصحيح - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (1/207))
