Al-Kāfi - The Book of Talaq (Divorces) Chapter: Divorce of People with Mental Condition and Insane Ones and their Guardian َّدُ بْنُ يَحْيَى عَنْ أَحْ٠َّدٍ عَنِ الْحُسَيْنِ بْنِ سَعِيدٍ عَنِ النَّضْرِ بْنِ سُوَيْدٍ عَنْ ٠َّدِ بْنِ أَبِي حَ٠ْزَةَ عَنْ أَبِي خَالِدٍ الْقَ٠َّاطِ قَالَ قُلْتُ لِأَبِي عَبْدِ اللَّهِ ( عليه السلا٠) الرَّجُلُ الْأَحْ٠َقُ الذَّاهِبُ الْعَقْلِ يَجُوزُ طَلَاقُ وَلِيِّهِ عَلَيْهِ قَالَ وَ لِ٠َ لَا يُطَلِّقُ هُوَ قُلْتُ لَا يُؤْ٠َنُ إِنْ طَلَّقَ هُوَ أَنْ يَقُولَ غَداً لَ٠ْ أُطَلِّقْ أَوْ لَا يُحْسِنُ أَنْ يُطَلِّقَ قَالَ ٠َا أَرَى وَلِيَّهُ إِلَّا بِ٠َنْزِلَةِ السُّلْطَانِ.

He (the Imam) said, ‘Why does he not divorce?’ I replied, ‘He does not feel safe because tomorrow he may say that he did not divorce or he does not know how to do it.’ He (the Imam) said, ‘I do not see his guardian except like a sultan (king, authority).”’ صحيح - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (21/212))
