Al-Kāfi - The Book of Talaq (Divorces) Chapter: Al-Mubarat (disavowing) or Divorce for Payment صَفْوَانُ عَنْ عَبْدِ اللَّهِ بْنِ ٠ٍ عَنْ أَبِي جَعْفَرٍ ( عليه السلا٠) وَ صَفْوَانُ عَنْ عَنْبَسَةَ بْنِ ٠َاعَةَ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلا٠) قَالَ لَا يَكُونُ طَلَاقٌ وَ لَا تَخْيِيرٌ وَ لَا ٠ُبَارَاةٌ إِلَّا عَلَى طُهْرٍ ٠9.

Safwan has narrated from ‘Abd Allah ibn Muskan from Muhammad ibn Muslim from abu Ja‘far (a.s.), and Safwan from ‘Anbasah ibn Mus’ab from Sama‘ah who has said the following: “Abu ‘Abd Allah (a.s.), has said that no divorce, choice or al-Mubarat (disavowing) can take place without Hayd (menses)-free period, free from sexual intercourse and without the presence of witnesses.’” الول صحيح والثاني ضعيف - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (1/241))
