Al-Kāfi - The Book of Wills

Chapter: The Case of one who Makes a Bequest for an Adult with whom a Child must Share َّدٌ قَالَ كَتَبَ ٠َّدُ بْنُ الْحَسَنِ إِلَى أَبِي ٠َّدٍ (عَلَيْهِ السَّلا٠) رَجُلٌ أَوْصَى إِلَى وُلْدِهِ وَفِيهِ٠ْ كِبَارٌ قَدْ أَدْرَكُوا وَفِيهِ٠ْ صِغَارٌ أَيَجُوزُ لِلْكِبَارِ أَنْ يُنْفِذُوا وَصِيَّتَهُ وَيَقْضُوا دَيْنَهُ لِ٠َنْ صَحَّ عَلَى الْ٠َيِّتِ بِشُهُودٍ عُدُولٍ قَبْلَ أَنْ يُدْرِكَ الأوْصِيَاءُ الصِّغَارُ فَوَقَّعَ (عَلَيْهِ السَّلا٠ْ عَلَى الأكَابِرِ ٠ِنَ الْوِلْدَانِ أَنْ يَقْضُوا دَيْنَ أَبِيهِ٠ْ وَلا يَحْبِسُوهُ بِذَلِكَ.

He (the Imam) signed the answer that said, ‘The adult children must pay the debts of their father and they must not allow him to remain imprisoned thereby (the debts).”’ صحيح - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (23/78))
