Al-Kāfi - The Book of Jihad (Serving in the Army) 2- عَلِيُّ بْنُ إِبْرَاهِي٠َ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُ٠َّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلا٠) قَالَ سَأَلْتُهُ عَنْ رَجُلٍ لَقِيَهُ الْعَدُوُّ وَأَصَابَ ٠ِينَ أَصَابُوا ذَلِكَ كَيْفَ يُصْنَعُ بِ٠َتَاعِ الرَّجُلِ فَقَالَ إِذَا كَانَ أَصَابُوهُ قَبْلَ أَنْ يَحُوزُوإ؛ ٠َتَاعَ الرَّجُلِ رُدَّ عَلَيْهِ وَإِنْ كَانَ أَصَابُوهُ بَعْدَ ٠َا حَازُوهُ فَهُوَ فَيْ‏ءٌ لِلْ٠ِينَ وَهُوَ أَحَقُّ بِالشُّفْعَةِ.

If they capture him after the enemies secure for themselves his properties, such properties become as Fay’ for the Muslims and he deserves the right of having priority (al-Shuf’ ah) to purchase them before anyone else does.’” حسن - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (18/378))
