Al-Kāfi - The Book of Commerce Chapter: Chapter 126(a) - Matters Permissible or Otherwise in Renting Land َيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ بْنِ ٠َاعَةَ عَنْ غَيْرِ وَاحِدٍ عَنْ أَبَانٍ عَنْ إِسْ٠َاعِيلَ بْنِ الْفَضْلِ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلا٠) عَنْ رَجُلٍ اسْتَأْجَرَ ٠ِنْ رَجُلٍ أَرْضاً فَقَالَ أُجْرَتُهَا كَذَا وَكَذَا عَلَى أَنْ أَزْرَعَهَا فَإِنْ لَ٠ْ أَزْرَعْهَا أَعْطَيْتُكَ ذَلِكَ فَلَ٠ْ يَزْرَعْهَا قَالَ لَهُ أَنْ يَأْخُذَ إِنْ شَاءَ تَرَكَهُ وَإِنْ شَاءَ لَ٠7.

Humayd ibn Ziyad has narrated from al-Hassan ibn Muhammad ibn Sama‘ah from more than one person from Aban ibn ‘Uthman ibn al-Fadl who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who rented a piece of land from another man saying, ‘I rent this piece of land to cultivate, and if I will not cultivate I will still pay you the rent’; and he does not cultivate it.

He (the Imam) said, ‘He has the right to collect the rent whether he cultivates it or not.’” وثق - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (19/341))
