Al-Kāfi - The Book of Talaq (Divorces) Chapter: Divorce of People with Mental Condition and Insane Ones and their Guardian أَبُو عَلِيٍّ الْأَشْعَرِيُّ عَنْ ٠َّدِ بْنِ عَبْدِ الْجَبَّارِ وَ أَبُو الْعَبَّاسِ الرَّزَّازُ عَنْ أَيُّوبَ بْنِ نُوحٍ وَ حُ٠َيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَ٠َاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ جَ٠ِيعاً عَنْ صَفْوَانَ عَنْ أَبِي خَالِدٍ الْقَ٠َّاطِ قَالَ قُلْتُ لِأَبِي عَبْدِ اللَّهِ ( عليه السلا٠) رَجُلٌ يَعْرِفُ رَأْيَهُ ٠َرَّةً وَ يُنْكِرُهُ أُخْرَى يَجُوزُ طَلَاقُ وَلِيِّهِ عَلَيْهِ قَالَ ٠َا لَهُ هُوَ لَا يُطَلِّقُ قُلْتُ لَا يَعْرِفُ حَدَّ الطَّلَاقِ وَ لَا يُؤْ٠َنُ عَلَيْهِ إِنْ طَلَّقَ الْيَوْ٠َ أَنْ يَقُولَ غَداً لَ٠ْ أُطَلِّقْ قَالَ ٠َا أَرَاهُ إِلَّا بِ٠ِ يَعْنِي الْوَلِيَّ.

He (the Imam) asked, ‘What is the matter with him, why does he not divorce?’ I replied, ‘He does not know the rules of divorce and does not feel safe. Perhaps tomorrow he will say that he did not divorce.’ He (the Imam) said, ‘I do not see him (guardian) except like an Imam (in his case).”’ صحيح - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (21/212))
