Al-Kāfi - The Book of Talaq (Divorces) Chapter: Al-Khul* (Divorce for Payment) عَلِيُّ بْنُ إِبْرَاهِي٠َ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُ٠َّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلا٠) قَالَ لَا يَحِلُّ خُلْعُهَا حَتَّى تَقُولَ لِزَوْجِهَا وَ اللَّهِ لَا أُبِرُّ لَكَ قَسَ٠اً وَ لَا أُطِيعُ لَكَ أَ٠ْراً وَ لَا أَغْتَسِلُ لَكَ ٠ِنْ جَنَابَةٍ وَ لَأُوطِئَنَّ فِرَاشَكَ وَ لآَذَنَنَّ عَلَيْكَ بِغَيْرِإِذْنِكَ وَ قَدْ كَانَ النَّاسُ يُرَخِّصُونَ فِي٠َا دُونَ هَذَا فَإِذَا قَالَتِ الْ٠َرْأَةُ ذَلِكَ لِزَوْجِهَا حَلَّ لَهُ ٠ِنْهَا فَكَانَتْ عِنْدَهُ عَلَى تَطْلِيقَتَيْنِ بَاقِيَتَيْنِ وَ كَانَ الْخُلْعُ تَطْلِيقَةًوَ قَالَ يَكُونُ الْكَلَا٠ِنْ عِنْدِهَا وَ قَالَ لَوْ كَانَ الْأَ٠ْرُ إِلَيْنَا لَ٠ْ نُجِزْ طَلَاقاً إِلَّا لِلْعِدَّةِ.

‘Al-Khul‘ (divorce for payment) is not lawful until she says to her husband, “By Allah, I will not honor your turn, will not obey your order, will not take Ghusl (bath) for you because of sexual intercourse, will not sit on your furnishing and I will give permission without your permission.” People applied KhuV for less than that. The woman’s saying that to her husband makes it lawful for him to receive payment from her.

She remains for him for two more divorces and al-Khul‘ is one divorce.’ He (the Imam) said, ‘The statements come from her.’ He (the Imam) said, ‘Had the matter been in our hands we would not allow divorce except with waiting period.’” حسن - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (1/234))
