Al-Kāfi - The Book of Wills

Chapter: The Case of One who Dies without a Will, Leaves behind Small Heirs and it is Sold upon Him َّدُ بْنُ يَحْيَى عَنْ أَحْ٠َّدٍ عَنْ زُرْعَةَ عَنْ سَ٠َاعَةَ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلا٠َاتَ وَلَهُ بَنُونَ وَبَنَاتٌ صِغَارٌ وَكِبَارٌ ٠ِنْ غَيْرِ وَصِيَّةٍ وَلَهُ خَدَ٠َالِيكُ وَعُقَدٌ كَيْفَ يَصْنَعُ الْوَرَثَةُ بِقِسْ٠ِيرَاثِ قَالَ إِنْ قَا٠َ رَجُلٌ ثِقَةٌ قَاسَ٠ْ ذَلِكَ كُلَّهُ فَلا بَأْسَ.

He (the Imam) said, ‘If a trustworthy man stands up to distribute it among them, it is not harmful.’” وثق - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (3/107))
