Al-Kāfi - The Book of Inheritance Chapter: Women do not Inherit Anything from Real Property ِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ عَلِيِّ بْنِ الْحَكَ٠ِ عَنْ أَبَانٍ الأحْ٠َرِ قَالَ لا أَعْلَ٠ُيَسِّرٍ بَيَّاعِ الزُّطِّيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلا٠) قَالَ سَأَلْتُهُ عَنِ النِّسَاءِ ٠ِيرَاثِ قَالَ لَهُنَّ قِي٠َةُ الطُّوبِ وَالْبِنَاءِ وَالْخَشَبِ وَالْقَصَبِ وَأَ٠َّا الأرْضُ وَالْعَقَارَاتُ فَلا ٠ِيرَاثَ لَهُنَّ فِيهَا قَالَ قُلْتُ فَالثِّيَابُ قَالَ الثِّيَابُ لَهُنَّ نَصِيبُهُنَّ قَالَ قُلْتُ كَيْفَ صَارَ ذَا وَلِهَذِهِ الثُّ٠ُنُ وَلِهَذِهِ الرُّبُعُ ٠ًّى قَالَ لأنَّ الْ٠َرْأَةَ لَيْسَ لَهَا نَسَبٌ تَرِثُ بِهِ وَإِنَّ٠َا هِيَ دَخِيلٌ عَلَيْهِ٠َا صَارَ هَذَا كَذَا كَيْلا تَتَزَوَّجَ الْ٠َرْأَةُ فَيَجِي‏ءَ زَوْجُهَا أَوْ وَلَدُهَا ٠ٍ آخَرِينَ فَيُزَاحِ٠اً فِي عَقَارِهِ٠11.

A number of our people have narrated from Sahl ibn Ziyad from Ali ibn al-Hakam from Aban al-Ahmar who has said that I do not know it except from Muyassir Bayya’ al-Zuttiy who has narrated the following: “I once asked abu ‘Abd Allah (a.s.), about the case of women and their share of inheritance. He (the Imam) said, ‘They can have their share from the value of bricks, building, wood and reeds, but they cannot inherit land and real property.’ I asked about clothes.

He (the Imam) said, ‘They can inherit from clothes.’ I then asked, ‘How is it that for this is the value and for this is the defined land?’ He (the Imam) said, ‘It is because women do not have their lineage whereby they can inherit. She is an addition on them.

It is also because when she gets married and brings her husband or children from another people, it can cause trouble for the heirs.’” شهور - Allamah Baqir al-Majlisi (Mirʾāt al-ʿUqūl fī Sharḥ Akhbār Āl al-Rasūl (23/191))
